LocalVIP Privacy Policy

Effective Date: April 23, 2025

LocalVIP is committed to protecting your privacy. This Privacy Policy explains how we collect, use, and share your information across our platform and applications, including our website (LocalVIP.com), our business portal (LocalVIP.com/business), CommunityGiveBackWeek.org, FreeMe.com and mobile apps available on Apple and Google Play stores. By using our services, you agree to the terms in this policy.

 1. Introduction

Welcome to LocalVIP. This Privacy Policy explains how LocalVIP, LLC (“LocalVIP,” “we,” “our,” or “us”) collects, uses, discloses, and safeguards your information when you use our website, mobile application, or any services, campaigns, tools, content, or features we provide (collectively, the “Services”). This Privacy Policy applies to all individuals and businesses who access or use our Services within the United States. By accessing or using our Services, you confirm that you have read, understood, and agree to the practices outlined here.

LocalVIP is committed to empowering local communities through loyalty-driven offers, cash-back campaigns, and referral-based incentives. We understand the importance of your privacy and make it a priority to handle all personal and business information responsibly and transparently. This Privacy Policy is designed to give you a clear understanding of how your information is treated—whether you’re joining as a community member (“Hero”) or registering as a local business.

This policy defines how data flows through our unique referral system, where participation enables users to earn and give back while remaining protected. Our 10-level referral structure depends on limited but essential data visibility, and we are committed to making sure that visibility is both purposeful and secure.

Please note: This Privacy Policy is binding and forms part of our Terms of Use. If you do not agree with any part of this Privacy Policy, you should refrain from using our Services.

We may update this Privacy Policy from time to time to reflect changes in legal requirements, technology, or business operations. We encourage you to review it periodically, as continued use of the Services means you accept any updates.

If you have questions about our data practices or your rights under this Privacy Policy, you can reach us anytime at support@localvip.com.

2. Information We Collect

To provide the full functionality of LocalVIP and deliver the value of our referral-based ecosystem, we collect and process various types of personal and business information. We only collect data that is relevant to our Services, necessary for compliance, or used to enhance your experience. This section outlines the categories of data we collect, how it’s obtained, and the reasons for collecting it.

We may also collect information from third-party platforms, social media integrations, or public sources to enhance functionality and user experience.

2.1 Personal Information You Provide

When you interact with LocalVIP, you may choose to provide personal information directly to us. This includes:

  • Registration Data: To create a Hero account, you are required to provide your first name, last name, city of residence, email address, and password. These details are necessary to verify your identity, maintain your referral lineage, and personalize your experience.

  • Business Data: Businesses registering with LocalVIP must provide the business name, the name and contact details of a representative, category or industry classification, business address, and other campaign-related preferences. This information supports offer creation, payout eligibility, and public visibility within the app.

We use this data to generate your account profile, track participation in campaigns, and deliver relevant offers.

2.2 Referral Relationship Data

LocalVIP is built on a multi-level referral system. To support this structure:

  • We track who referred you and who you refer, up to 10 levels deep.

  • Heroes can view the first name, last initial, and city of users connected to them within this tree.

  • Businesses can view only the business name of others within their referral structure—never personal contact data.

This system ensures transparency and accountability while maintaining strict limits on data visibility.

2.3 Interaction and Activity Data

We collect data as you engage with our Services:

  • QR Code & Link Interactions: When you scan a QR code or click a link to sign up, redeem, or refer someone, we log the event, timestamp, and context to confirm referral accuracy and reward eligibility.

  • App Usage & Behavior: We monitor how you interact with the app, including screens visited, time spent, clicks, feature engagement, and redemption history. This helps us improve app usability and offer performance.

2.4 Device and Technical Information

When you use LocalVIP, we automatically collect technical data, such as:

  • IP address, device model, operating system, app version, and browser type

  • Language preferences and approximate location (if enabled)

  • Diagnostic logs and performance data (e.g., app crashes or latency issues)

This information is vital for platform optimization, fraud prevention, and geo-targeted feature delivery.

2.5 Sensitive and Financial Data

We do not collect or store credit card numbers, account data or payment account credentials. All payments are securely processed through Stripe, our third-party payment processor. Stripe handles sensitive data per their privacy standards and is solely responsible for PCI compliance.

We only store transaction references, status updates, and metadata necessary for accounting, audit trails, and reward calculations.

3. How We Use Your Information

The information we collect through your use of LocalVIP is essential to delivering our Services, maintaining the referral structure, supporting businesses and heroes, and ensuring smooth, secure operation of our platform. This section outlines the specific ways we use your data, aligned with applicable data protection laws and ethical principles.

3.1 To Provide and Manage Your Account

We use your registration and profile data to establish and maintain your user or business account. This includes:

  • Authenticating your identity at login

  • Storing your referral relationships

  • Maintaining your preferences and linked campaigns

  • Managing your participation in Community Give Back Week or other promotions

  • Ensuring your access to features relevant to your role (Hero or Business)

This data is foundational to your experience with LocalVIP and is required to use the platform effectively.

3.2 To Maintain Referral Chains and Incentive Tracking

Our platform uses multi-level tracking (up to 10 levels) to power the reward ecosystem. We use referral metadata to:

  • Assign new users to the correct referral level and lineage

  • Attribute referrals accurately for reward eligibility

  • Allow heroes to view the limited identifying data (first name, last initial, city) of their downline and upline connections

  • Allow businesses to see only the business names in their referral network

These uses are fundamental to our model and are never extended beyond this scope.

3.3 To Personalize Offers and Notifications

Using your city of residence, app behavior, QR interactions, and referral connections, we tailor:

  • Notifications about offers near you

  • In-app recommendations based on your history and patterns

  • Campaign alerts relevant to your level or participation

Personalization is performed without revealing sensitive data and never involves the resale or external sharing of your identity.

3.4 For System Performance, Testing, and Development

We use aggregated usage data and diagnostic logs to:

  • Identify and resolve bugs or crashes

  • Test new features and A/B improvements

  • Analyze platform traffic and performance trends

  • Ensure compatibility across devices and app versions

We may use third-party services for this purpose, but only under contracts that prohibit misuse or unauthorized access to your data.

3.5 For Legal and Regulatory Compliance

In some instances, we are required to use or retain your data to:

  • Comply with tax reporting or accounting obligations

  • Respond to lawful requests from public authorities

  • Enforce our Terms of Service or resolve disputes

  • Prevent abuse, fraud, or misuse of referral systems

Where legally compelled to disclose personal information, we do so in accordance with due process and relevant law.

3.6 For Communications and Service Announcements

We may use your contact information to:

  • Send service-related notices, such as feature updates, policy changes, and account verification emails

  • Provide promotional communications, which you can opt out of at any time

  • Respond to your inquiries or support requests

We do not use your contact details to send third-party advertisements, nor do we rent or sell your email or phone number.

4. How We Share Information

LocalVIP is built on transparency, integrity, and a commitment to user trust. While we collect a range of data to deliver our services effectively, we share only what is necessary—and only under specific, clearly defined circumstances. This section outlines how, when, and with whom we share personal and non-personal information, and the safeguards we have in place.

4.1 Referral Network Visibility

LocalVIP’s unique model relies on a structured referral network, where each user’s participation is part of a larger chain of up to ten levels. For the reward system to function properly:

  • Heroes (users) will have their first name, last initial, and city visible to the ten levels of users who directly or indirectly enabled their sign-up.

  • Businesses will have only their business name visible to the launch team partners who form their ten-level referral tree.

  • No other personal information—such as email, full name, phone number, or address—is shared within this structure.

This design balances functionality with privacy, ensuring the referral mechanism works without exposing sensitive data.

4.2 Third-Party Service Providers

To support core functionalities, we work with verified service providers under strict confidentiality agreements. These providers help us:

  • Host and maintain our platform infrastructure

  • Deliver email notifications and app messaging

  • Analyze performance and usage metrics

  • Process payments securely through Stripe

These third parties access only the information they need to perform their functions and are legally prohibited from using your data for any other purpose. They are required to implement safeguards that meet or exceed industry standards for data protection.

4.3 Legal Disclosures and Obligations

We may disclose your data if legally required to do so. This includes:

  • Responding to a subpoena, court order, or legal process

  • Cooperating with law enforcement in the investigation of fraud, criminal activity, or threats to safety

  • Complying with regulatory obligations, such as tax documentation

We do not comply with informal requests or vague demands. All disclosures must be backed by legally binding documentation or statutory obligations.

4.4 Protection of Rights, Security, and Integrity

We may share limited user data if we reasonably believe it is necessary to:

  • Enforce our Terms of Use or other contractual rights

  • Detect, prevent, or address fraudulent or unauthorized activity

  • Protect the safety and integrity of the platform, our users, or the general public

Any such sharing is done under a strict need-to-know basis and subject to internal review to avoid abuse.

4.5 Business Transfers

If LocalVIP is involved in a merger, acquisition, asset sale, or corporate restructuring, your personal information may be transferred as part of that transaction. However:

  • The acquiring entity will be required to honor the commitments in this Privacy Policy.

  • You will be notified via email and/or a prominent notice in the app before any material changes to privacy practices take effect.

4.6 Aggregated and Anonymized Information

We may compile statistical, non-identifiable data from our users to improve operations, guide product development, or report on platform performance. Examples include:

  • Total number of redemptions in a region

  • Most active QR code campaigns

  • Aggregate usage trends

5. Cookies and Tracking Technologies

To provide an efficient, responsive, and personalized experience, LocalVIP uses cookies and similar tracking technologies in both our mobile application and web-based services. These tools are essential for maintaining security, analyzing performance, and tailoring interactions based on user behavior. This section explains what technologies we use, why we use them, and how you can manage your preferences.

5.1 What Are Cookies and Tracking Technologies?

Cookies are small text files placed on your device by our systems or by third-party partners when you use our Services. In addition to cookies, we may also use:

  • Pixel tags (also known as web beacons): These are small graphics that monitor user interactions with content and can measure the effectiveness of email campaigns or user engagement.

  • Local storage and in-app data caching: These methods store information within your device to speed up loading times and maintain session consistency.

  • Device and session identifiers: These help us distinguish repeat visits, track app activity, and detect abnormal use or potential abuse.

These technologies do not give us access to your device, files, or personal content beyond what you explicitly share or permit within the app or browser.

5.2 Why We Use These Technologies

We use cookies and tracking tools for several essential purposes:

  • Performance Optimization: To load pages and app features more quickly and improve responsiveness across device types and network conditions.

  • Functionality: To remember user preferences, maintain login sessions, and support navigation between sections of the app without disruptions.

  • Analytics and Diagnostics: To gather data on how features are used, which screens are most visited, and where users may encounter bugs or slowdowns. This helps us make better design and engineering decisions.

  • Security Monitoring: To detect suspicious patterns, such as repeated failed login attempts or automated scanning of QR codes, helping to protect against fraud or abuse.

  • Location-Dependent Personalization: If location permissions are granted, we may use tracking to offer geographically relevant rewards, notifications, or reminders.

We do not use tracking technologies to collect sensitive personal data or sell information to third parties. All tracking is used for internal operational and service-related purposes only.

5.3 Third-Party Services and Analytics

We may incorporate third-party analytics services such as Google Analytics for Firebase, Mixpanel, or similar tools to help measure usage patterns, campaign effectiveness, and system performance. These tools may use cookies or SDKs within the app to collect usage data in a way that does not identify you personally.

All third-party services used are contractually obligated to adhere to privacy standards aligned with U.S. data protection requirements and must not use your data for unrelated purposes.

5.4 Managing Cookie and Tracking Preferences

As a user, you have the ability to control how and whether tracking technologies are used through the following means:

  • Browser settings: You can adjust cookie settings in your web browser to block or delete cookies. Each browser provides different tools, and changing settings may impact your user experience.

  • Device-level permissions: On mobile devices, you can disable app permissions related to location or data usage through your operating system settings.

  • In-app preferences: Where available, we may offer toggle options within your user profile or privacy settings to adjust notification and tracking behavior.

  • Opt-out mechanisms: For analytics services that support opt-out functionality, we honor industry-standard protocols where applicable.

Note that disabling certain cookies or tracking tools may affect the functionality or personalization capabilities of LocalVIP, including how offers and deals are delivered to you.

6. Location Data

LocalVIP may request access to your device’s location data in order to deliver a more contextually relevant and personalized experience within our Services. This data helps us enhance user engagement, target local promotions, and present businesses or events that are geographically near you. This section details how and when we collect location information, what we use it for, and how you can control these settings.

6.1 Collection of Location Data

Location data is only collected if you explicitly grant us permission via your device’s operating system. We do not collect real-time GPS information without your consent. Depending on your settings, the types of location data we may collect include:

  • Precise location (e.g., GPS coordinates)

  • Approximate location (e.g., city or region based on network or IP address)

  • Background location data, if explicitly permitted for certain functionality (e.g., continuous proximity alerts or location-aware promotions)

We also log timestamped location events associated with key in-app activities—such as scanning a QR code at a participating business or receiving a nearby offer notification—if location tracking is enabled at that moment.

6.2 How Location Data Is Used

The location information we collect is used strictly to enhance and personalize your use of LocalVIP. This includes:

  • Delivering hyper-local deals and promotions from businesses in your vicinity

  • Alerting you to time-sensitive events nearby, such as Community Give Back Week campaigns

  • Verifying your presence at a physical location when redeeming an in-person offer or reward

  • Improving recommendation algorithms by understanding what types of businesses or campaigns are relevant to your physical habits and preferences

Location data is not stored indefinitely. It is retained only as long as is necessary to fulfill the purpose for which it was collected, after which it is securely deleted or anonymized for aggregate insights.

6.3 Third-Party Location Services

We may rely on location services provided by your device’s operating system or third-party SDKs (e.g., Google Location Services or Apple Core Location) to interpret raw location data. These services do not have access to your personal identity within our platform and are subject to their own privacy practices. We require that any third-party tools we integrate comply with data minimization and security obligations.

6.4 User Control and Opt-Out

You are always in control of whether or not LocalVIP can access your location:

  • You may enable or disable location permissions through your device’s app settings at any time.

  • You may adjust your settings to allow only “while using the app” access or to block background tracking entirely.

  • You may still use the app without enabling location data, but some features—like local deals, in-store QR scans, or proximity alerts—may be limited or unavailable.

We respect your choices. No location-based features will be activated unless permission is granted. If at any point you wish to revoke location access or delete any stored location data, please contact us at support@localvip.com, and we will comply promptly.

7. Data Security

At LocalVIP, the privacy and integrity of your data is a core priority. We have implemented a comprehensive security framework to safeguard your personal, business, and behavioral data from unauthorized access, misuse, loss, or alteration. This section outlines the measures we take to protect your information and what you can do to help secure your account.

7.1 Security Measures We Implement

We apply a multi-layered approach to data protection, combining technical safeguards, administrative procedures, and physical controls to ensure that your information remains secure.

Technical Safeguards include:

  • Encryption of data both at rest and in transit using industry-standard protocols such as TLS (Transport Layer Security) and AES-256.

  • Access controls to ensure only authorized personnel or systems can access sensitive information, with role-based permissions enforced across our backend systems.

  • Firewall protection and intrusion detection mechanisms to monitor for suspicious activity or unauthorized access attempts.

  • Regular vulnerability scanning and software updates to ensure our systems are current and resistant to known security exploits.

Administrative Controls include:

  • Mandatory employee training on data privacy and security protocols

  • Internal access audits and logging to track data access or administrative changes

  • Background checks and contractual data security requirements for staff and vendors who may interact with sensitive systems

Physical Security is managed by our infrastructure providers (e.g., cloud data centers), who maintain 24/7 monitoring, biometric access controls, environmental hazard protection, and strict entry protocols for physical locations hosting our servers.

7.2 Stripe and Payment Security

LocalVIP does not process or store your payment card details. All transactions are handled securely through Stripe, a PCI-DSS compliant payment processor that uses advanced encryption and fraud detection protocols. By using Stripe, we minimize the risk of payment data breaches and shift financial data responsibility to a trusted provider that meets or exceeds industry security benchmarks.

7.3 Your Responsibilities as a User

While we take every reasonable step to protect your data, security is also a shared responsibility. You can help keep your account secure by:

  • Using strong, unique passwords and updating them regularly

  • Avoiding reuse of login credentials across multiple platforms

  • Keeping your device and app updated to receive the latest security patches

  • Not sharing your account details or QR code referrals with untrusted individuals

  • Logging out of public or shared devices when finished using the app

If you suspect unauthorized access or detect suspicious activity associated with your account, you should notify us immediately at support@localvip.com so we can investigate and take appropriate action.

7.4 Breach Notification Protocol

In the unlikely event of a data breach that may compromise your personal information, we will notify affected users without unreasonable delay. This may include in-app messaging, email notification, or other forms of direct communication, in accordance with applicable U.S. state privacy laws and regulatory requirements.

8. Children’s Privacy

LocalVIP is designed to be a community platform for adults, business owners, and community members who are eligible to enter into legally binding agreements under applicable laws. We do not knowingly collect, solicit, or store personal information from individuals under the age of 13, and our Services are not directed toward children under this age.

8.1 No Use by Children Under 13

We have structured our Services to be inappropriate for use by children. As such:

  • We do not permit anyone under the age of 13 to create an account, register a business, or participate in our promotional, rewards, or referral systems.

  • During registration, users are required to confirm that they are at least 13 years old. Individuals under this age are strictly prohibited from using the Services.

  • We do not knowingly request or collect any information that may fall under the Children’s Online Privacy Protection Act (COPPA). If it is brought to our attention that such data has been inadvertently collected, we will act promptly to delete it.

If you are a parent or legal guardian and believe that your child under 13 has provided us with personal data, please contact us immediately at support@localvip.com, and we will take swift steps to remove such information from our records and systems.

8.2 Users Aged 13 to 17

Users between the ages of 13 and 17 may access our Services only with the involvement, consent, and supervision of a parent or legal guardian. By using LocalVIP, these users affirm that they have obtained such parental approval.

While we do not proactively collect age-related data for users aged 13 to 17, we encourage parents and guardians to monitor their children’s online activities and to help enforce appropriate privacy and safety measures. We may, at our discretion, remove accounts if we discover they are being used in violation of these guidelines or our Terms of Use.

8.3 Age Verification and Enforcement

To maintain compliance and uphold a safe environment for all users, we may employ technical or procedural measures to verify a user’s age. This may include prompts during onboarding, audits of user-provided information, or requesting documentation in rare instances where age misrepresentation is suspected.

We reserve the right to suspend or terminate accounts that violate this policy, especially those that belong to individuals under 13 or those misrepresenting their age to bypass restrictions.

8.4 Educational Institutions and Promotional Use

LocalVIP does not target its promotional campaigns or reward programs to children. Even when schools or youth organizations participate in Community Give Back Week or other initiatives, any data collection is limited to adult representatives of the organization. We will never request personal information directly from minors in such contexts.

9. Your Rights

At LocalVIP, we believe transparency and user control are essential parts of data privacy. As a user of our Services in the United States, you have a set of rights that allow you to understand and, when necessary, manage the personal data we collect about you. These rights vary depending on your state of residence, but LocalVIP is committed to honoring and facilitating all applicable rights under U.S. privacy laws.

We will not deny Services, charge different prices, or provide a different level of service based solely on your decision to exercise any of your privacy rights.

9.7 How to Exercise Your Rights

To make a privacy-related request, please contact us at support@localvip.com. We may need to verify your identity before fulfilling any request to protect your data from unauthorized access.

This address can be used for official legal correspondence, such as privacy rights requests submitted in writing or service of process. Please note that responses sent via physical mail may take longer to process.

  • In-App Support:
For convenience, users may also submit inquiries directly within the LocalVIP mobile application under the “Support” or “Help” section. These messages are logged and monitored by our customer service team, who will escalate privacy matters to our designated compliance officers.

We endeavor to respond to all inquiries within 30 calendar days, though certain complex requests—such as those involving data access, correction, or deletion—may take longer depending on the scope and verification requirements.

12.2 Verification Process

To protect your privacy, we may need to verify your identity before processing certain requests related to your personal data. This may include:

  • Confirming details such as your account credentials, device ID, or email address

  • Asking for additional verification if you are acting on behalf of another user (such as legal guardians, authorized agents, or business representatives)

We take verification seriously to ensure that sensitive data is not improperly disclosed or modified.
